These Terms of Use govern your use of ewbeverages.com, kingfisher.beer and the brand websites that point to them (the "Sites"), operated by East West Beverages, Inc. ("EWB," "we," "us"). By using the Sites, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Sites.
You must be 21 or older
The Sites are intended only for people of legal drinking age, 21 or older in the United States. By using the Sites, you confirm that you are at least 21. Please enjoy our beers responsibly, and never drink and drive.
We do not sell alcohol online
The Sites provide information about our beers and where to find them. We do not sell or ship alcohol through the Sites. Our beers are sold by licensed retailers, restaurants and distributors, and availability, pricing and product offerings vary by state and location.
Store finder and product information
Our store finder lists places that have bought our beers, based on information from our distributors and public records. Listings may be incomplete or out of date, and a location may not have a particular beer in stock when you visit. We recommend calling ahead. Product details, sizes, availability dates and awards are provided for information and may change.
Trademarks and content
The Sites and their content, including text, photos, designs and logos, are owned by EWB or used with permission. Taj Mahal, Flying Horse, Maharaja, Kingfisher, Chang and related names, logos and label designs are trademarks of their respective owners and are used under license: [CONFIRM OWNERSHIP LINE FOR EACH BRAND]. Retailer names and logos belong to their owners and do not imply endorsement. You may view and share the Sites for personal, noncommercial use. You may not copy, modify, sell or reuse our content or marks without our written permission.
What you send us
If you send us messages, ideas or other material through the Sites, you confirm that you have the right to send it and that it is accurate. You agree that we may use feedback and ideas you send without paying you. Do not send us confidential information through the Sites.
Acceptable use
You agree not to:
- Use the Sites if you are under 21, or help anyone under 21 use them
- Use the Sites for anything unlawful, or to send spam, harmful code or false information
- Scrape, copy or collect information from the Sites by automated means without our permission
- Interfere with the Sites' operation or security, or try to access areas you are not allowed to
Links to other sites
The Sites link to websites we do not control, including retailer store finders, our brand partners' sites and Instagram. We are not responsible for their content, products or privacy practices.
Disclaimers
The Sites are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Sites will be uninterrupted, error free or secure.
Limitation of liability
To the fullest extent allowed by law, EWB and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Sites. Our total liability for any claim relating to the Sites will not exceed $100. Some states do not allow these limits, so they may not apply to you.
Indemnity
You agree to defend and hold harmless EWB from claims, losses and costs, including reasonable attorneys' fees, arising from your misuse of the Sites or your breach of these Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute relating to the Sites will be brought in the state or federal courts located in Marin County, California, and you consent to their jurisdiction.
Changes to these Terms
We may update these Terms. The effective date at the top shows when they last changed. Continuing to use the Sites after a change means you accept the updated Terms.
